In endorsement of the letters No:- AICAEA/HQ/A-2/2018/152-155 dated 05.05.2018 of All India Civil Accounts Employees Association, No:- AICAEA Cat II/HQ/5-2/Cadre Review/2018-2019 dated 05.05.2018 of All India Civil Accounts Employees Association Category –II and No:- AIPAO©/CHQ/2018-19/Cad Re/1 dated 05.05.2018 of All India Association of Pay and Accounts Officer (Civil), we on behalf of entirety of the Group B&C Officers and employees would like to state that, the “Internal Cadre Review Committee” constituted vide OM No:- 32014/1/2014/MF.CGA/Group B/Cadre Review/911 dated 16th January 2018 had completed its three months term on 15th April 2018 and all the three major Associations named above have submitted the proposal for Cadre Review in an unified and under a rationalized approach within 20th April, 2018.
However, your office vide OM No:- A-32014/2014/MF.CGA/Gr-B/Cadre Review/80 dated 19th April 2018 has extend the term of Internal Cadre Review Committee upto 15th August 2018.
But, we are of the opinion that, one more month’s time for the Internal Cadre Review Committee from the date submission of proposals by the Associations is sufficient for submission of report by it and there is no need for extension of its term till 15th August 2018.
We therefore, request you to direct the Internal Cadre Review Committee to submit its recommendations to your kind self within 31st May 2018 so that the first Cadre Review of the Group B&C Cadres is implemented without further delay as it has been delayed by more than thirty five years by now.
Since our members have become totally restive, we request you to kindly take early favorable action so that the prevailing peace and tranquility in the organization continues.

Sub: Music and Dance competition for wards of Central Government Employees
Central Civil Services Cultural & Sports Board has been organising the Music, Dance and Shor Play competition for central Government Employees for the last many years. There were demands from a large number of participants and employees that a similar programme may also be started for their wards to motivate and encourage them.
It is therefore, proposed to organise the Music and Dance competition for wards of Central Government Employees at Auditorium on 30-31 May, 2018. The entry for the competition should be sent in the prescribed form to the Board’s Office latest by 25th May, 2018 at Room No.361, 3rd Floor, Lok Nayak Bhawan, Khan Market, New Delhi-110003 or by email at sportsdopt@gmail.com

Sub: Procedure to be observed by the Departmental Promotion Committees (DPCs) – Model Calendar for DPCs – Relevant year up to which APARs are to be considered and Model Calendar for conducting DPCs – regarding.
The undersigned is directed to invite reference to the Department of Personnel and Training’s OM of even number dated 8th May, 2017 vide which instructions for procedure to be observed by the Departmental Promotion Committees (DPCs) – Model Calendar for DPCs – Relevant year up to which APARs are to be considered and Model Calendar for conducting DPCs were issued.
2. A reference has been received whether the OM dated 28.1.2015 and the above mentioned OM dated 8.5.2017 will co-exist. The matter has been examined and it has been decided that the OM dated 8.5.2017 will supercede all the instructions issued on the subject of Model Calendar for Departmental Promotion Committees, including the OM dated 28.1.2015. In other words, the instructions issued uide OM dated 8.5.2017 are applicable in all cases, i.e.,whether or not it requires DPC to be convened in UPSC or internally within the Departments / Ministries.
3. Ministries/Departments are requested to give wide circulation to these instructions for guidance in the matter and also to ensure strict adherence to the time-schedule prescribed as per the ‘Model Calendar’ for DPCs.

Pension Fund Regulatory and Development Authority (PFRDA) has been established by the Government of India for regulation and development of Pension Sector in order to protect the old age income security of subscribers. PFRDA takes various initiatives from time to time in order to simplify and improve the operational issues in National Pension System (NPS) like new functionality development under NPS architecture, simplification of account opening, withdrawal, grievance management etc. In this regard, it has been decided by the Authority to make bank account details and mobile no. mandatory to provide ease of operation for the benefit of subscribers and make the process of Exit from NPS hassle free.
Further, in compliance with the Prevention of Money Laundering Act guidelines issued by the Government of India, Foreign Account Tax Compliance Act (FATCA) and Central Registry of Securitization Asset Reconstruction and Security Interest (CERSAI) have been made mandatory for new as well as existing subscribers. These have been made mandatory in the new Common Subscriber Registration Form (CSRF) forms that are required to be filled in by the new subscribers. The existing subscribers have been provided the facility to submit online FATCA Self-Certification in their login (www.cra-nsdl.com or https://enps.karvy.com/Login/Login ). The information regarding the said functionality is also made available on Central Record-keeping Agency (CRA) websites. The steps to be followed by the subscriber to submit online FATCA self-certification are also mentioned on the website.
It is to be ensured by the subscribers to fill the mandatory fields correctly and not leave them blank in order to avoid rejection of their forms.

Subject: Common mistakes by PAOs in processing of Revision of Pension under
7th CPC .
7th CPC Pension Revision cases are to be settled in a time bound manner. This office is receiving more than 3000 pension revision cases on daily basis. However, it has been observed that about 5 to 10 percent cases are returned by this office to PAOS due to Various discrepancies. The reasons to return are indicated by this office in each case. To facilitate the PAOs, a list of common mistakes made by PAOs has been prepared and enclosed herewith at Annexure-A.
In view of above all the PAOs are requested to ensure that 7th CPC revision cases are sent correctly to CPAO to speed up the processing of the same in a time bound manner.

JCM national council, Staff Side, has demanded that under the existing orders the option to come over to revised pay structure from the date of promotion is available only for those employees who are promoted before 25.07.2016. The staff side has demanded that such an option of fixation of pay for coming over to revised pay scale may be given to employees promoted after 25.07.2016 also. The staff side has contended that not giving such an option to an employee who was due for promotion on a date after 25.07.2016 (say on 26.07.2016) will be discriminatory. Government has considered the demand and rejected. The following is the reply of the Finance Ministry, Department of Expenditure.

The position on action taken in respect of item regarding permission to opt for pay fixation in the revised pay structure on a date after the issue of CCS (RP) Rules 2016 (notification on 25.07.2016) in the case of employees whose promotion becomes due after 25.07.2016 is given below:
In the said item the staff side has demanded that under the existing orders the option to come over to revised pay scale from the date of promotion is available only for those employees who are promoted before 25.07.2016, the date of notification of CCS (RP) Rules 2016. The staff side has demanded that such an option of fixation of pay for coming over to revised pay scale may be given to employees promoted after 25.07.2016 also. The staff side has contended that not giving such an option to an employee who was due for promotion on 26.07.2016 (one day after the date of notification) and afterwards will be discriminatory.
The revised Pay rules contained in CCS (RP) Rules 2016 are effective from 01.01.2016. A person holding a particular post as on 01.01.2016 has an option to come over to revised pay scale applicable to that post either straight away on 01.01.2016 or from a date later than that such an option is clearly mentioned in provisio 1 and provisio 2 of Rule 5. A combined reading of provisio 1 and provisio 2 to Rule 5 provided that a Government Servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increment in the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure.
But, in cases where a Government servant has been placed in a higher grade pay or scale between 01.01.2016 and the date of notification of CCS (RP) Rules 2016 on account of promotion or upgradation, the Government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation.
Therefore the rules provide while in respect of post held by a Government Servant as on 01.01.2016, the concerned Government Servant may elect to come over to revised pay scaleapplicable to that post either from 01.01.2016 or from a date later than 01.01.2016, in case he is promoted to a post not held by him on 01.01.2016 on a date later than that, then he can opt to come over to revised pay scale from the date of promotion provided such promotion takes place between 01.01.2016 and the date of notification. Thus the date of notification of the Rules on 25.07.2016 which are effective from 01.01.2016 is the outer limit for option in cases the option is from date of promotion. The similar was the provisions in the Rules pertaining to the 6th CPC in terms of CCs (RP) Rules 2008. This is the fair and time tested rule, as it seeks to allow option in case of promotion during the retrospective effect of the Rules. There has to be outer date and that date is the date of notification of CCS (RP) Rules 2016, which is objective and of fair application. No such objective date beyond 25.07.2016 could be of fair application.
MAHARASHTRA FARMERS STRUGGLE
WIND OF CHANGE
Confederation of Central Government Employees and Workers, CHQ, Congratulates the farmers of Maharashtra for the historic “Kisan long March” from Nasik to Mumbai. Around 50000 farmers have marched on foot, under the leadership of Maharashtra State Committee of All India Kisan Sabha (AIKS), for around 200 kilometers braving the scorching sun to press their demands before the BJP Government of Maharashtra. The State Government was compelled to concede in writing their demands including loan waivers, right to forest lands for the tribals tilling the lands for decades, Minimum Support price for agriculture products as per Swaminathan Committee recommendation etc.
The successful struggle of the farmers of Maharashtra has inspired the entire country, particularly the workers across the country. The working class stood in solidarity with the struggling farmers earlier in Rajasthan and now in Maharashtra. Central Government Employees under the banner of Confederation of Central Govt. Employees and Workers will continue to support the genuine demands of the farmers all over the country and stand firmly in solidarity with them.

Minutes – Reacting to the comment made by the official side, the staff side pointed out that prima-facie, on introduction of computerized functioning in almost all departments, the functions assigned to LDCs have become redundant.
Decision - What is required is to get the report from each department and take a conscious decision, as LDC is a common category.
Report of the Ministry of Railways (OM dated 01.12.2017)
In view of functional requirement of Ministry of Railways (Railway Board) and promotional aspects of MTS, proposal to abolish and upgrade all posts of LDCs (LDC now as Junior Secretariat Assistant) to UDCs (now called as Senior Secretariat Assistant) may not be recommended and besides this, RBSCS is patterned on the lines of the CSCS and the existing system is working well, unless there is any change in CSCS, no change is desirable in RBSCS. 7th CPC has also not provided upgradation of to LDCs; therefore to abolish and upgrade all posts of LDCs to UDCs is considered not feasible.

Subject: Setting up of Anomaly Committee to settle the anomalies arising out of the implementation of the Seventh Pay Commission's recommendations — extending the scope of definition regarding.
The undersigned is directed to refer to DoPT's Office Memorandum of even number dated 20/02/2017 on the subject as cited above, and to incorporate the following further modification in the definition of what would constitute an anomaly:
"where the amount of revised allowance is less than the existing rate or any other anomaly observed while implementing the revised allowance"
2. With the incorporation of the above para in the OM, the definition of anomaly will read as follows:-
(1) Definition of Anomaly
Anomaly will include the following cases
a) Where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the Seventh Central Pay Commission itself without the Commission assigning any reason;
b) Where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Pay Band under the pre-revised structure as notified vide CCS(RP) Rules 2016, is less than the amount an employee is entitled to be fixed at, as per the formula for fixation of pay contained in the said Rules;
c) Where the Official side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.
d) Where the amount of revised allowance is less than the existing rate or any other anomaly observed while implementing the revised allowance
3. The rest of the contents of the OM issued by DoPT under reference no. No.11/2/2016-JCA dated 16.08.2016 shall remain unchanged.
